2019 Updated CDLE worker misclassification resources

The Colorado Dept. of Labor & Employment (CDLE) has launched a new campaign to educate employers and workers in the construction industry — particularly in drywall — about how to know if a worker should be classified as an employee or an independent contractor. CDLE is sending materials such as informational posters directly to employers and is reaching out to workers through social media and public service ads.

The campaign arose from discussions at the Worker Misclassification Task Force established in 2018 and overseen by CDLE. The department also is working to streamline information-sharing among its unemployment insurance, labor statistics, and workers’ compensation divisions and between itself and the Department of Revenue. These and other efforts are designed to minimize inappropriate misclassification and help both employers and workers understand their rights.
